Terms and conditions

1. Purpose

These General Terms and Conditions of Sale (hereinafter referred to as the “GTCS”) govern the contractual relationship between Emmanuel Cachau-Herreillat, an independent paragliding instructor, hereinafter referred to as the “Service Provider”, and any natural or legal person purchasing services via the Air Parapente Chambery website, hereinafter referred to as the “Client”.

The GTCS apply to all services offered on the website, including tandem paragliding flights and, where applicable, paragliding instruction services.

3. Acceptance of the GTCS

In accordance with applicable e-commerce regulations, any order or reservation made on the website implies the Client’s full and unconditional acceptance of these GTCS.

During the online booking process, the Client must tick a box confirming that they have read and accepted the GTCS without reservation before final validation.

4. Services Offered

The Service Provider offers paragliding services supervised by a state-certified instructor, in compliance with current French regulations.

The services are described on the website as accurately as possible. They mainly include tandem paragliding flights and may also include paragliding instruction services.

However, variations may occur depending on weather conditions, safety requirements, or the Client’s skill level.

5. Practice Conditions

Paragliding is an outdoor sporting activity subject to weather conditions and safety requirements.

The Client declares that they:

  • Are physically fit to practice paragliding;

  • Have no known medical contraindications;

  • Will comply with the safety instructions given by the instructor.

The Service Provider reserves the right to refuse or interrupt the service if safety conditions are not met.

6. Prices

Prices for services are stated in euros (€), all taxes included (VAT included).

The Service Provider reserves the right to modify prices at any time. However, the price applied will be the one in effect at the time of booking.

7. Booking and Payment

Bookings are made online via the website.

A booking becomes firm and final once online payment has been validated or once payment in person has been confirmed, depending on the option chosen by the Client.

Accepted payment methods are: online payment and payment in person (according to the terms specified during booking).

In the event of non-payment or failure of the Client to attend, the Service Provider reserves the right to cancel the booking under the conditions set out in Article 9.

8. Gift Vouchers

No gift vouchers are offered for sale on the website.

9. Cancellation and Rescheduling

9.1 Cancellation by the Client

Any cancellation by the Client must be notified in writing (email).

  • Cancellation up to 24 hours before the scheduled date: free cancellation or rescheduling of the service;

  • Cancellation less than 24 hours before the scheduled date or no-show by the Client: the full service price remains due.

9.2 Cancellation by the Service Provider

The Service Provider reserves the right to cancel or reschedule the service in the event of unfavorable weather conditions, safety constraints, or force majeure.

In such cases, a new date or a refund will be offered to the Client, without any additional compensation.

10. Right of Withdrawal

In accordance with Article L221-28(12) of the French Consumer Code, the right of withdrawal does not apply to leisure services provided on a specific date or during a specific period.

By validating their online booking, the Client expressly acknowledges waiving their right of withdrawal.

11. Liability

The Service Provider holds the qualifications required to professionally supervise paragliding activities and operates in compliance with current French regulations.

The Service Provider holds professional civil liability insurance for the supervision of paragliding activities.

The Service Provider shall not be held liable in the event of failure by the Client to comply with safety instructions, undeclared physical unfitness, or force majeure.

12. Insurance

The Client is informed that they may take out personal accident insurance if they so wish.

13. Personal Data

Personal data collected are necessary for the management of orders and services.

They are processed in accordance with applicable regulations (GDPR). The Client has the right to access, rectify, and delete their data.

14. Intellectual Property

All content on the website (texts, images, logos, videos) is protected by intellectual property law and remains the exclusive property of the Service Provider.

15. Applicable Law and Disputes

These GTCS are governed by French law.

In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the competent courts shall be those within the jurisdiction of the Service Provider’s registered office.
